TERMS OF SERVICE
1.Usage of Socchh
The Socchh Platform (including any mobile-based applications, website, and web applications) is provided by Mindcentric Tech Private Limited (“Socchh”, “we”, “our”, or “us”). Through the Socchh Platform, any person with a verified account can access and participate in upskilling services and offerings (“User”) provided via Socchh. Employers may onboard their workforce and offer training and development opportunities using the platform.
A User accessing the Socchh Platform shall be bound by these Terms of Service, and all other rules, regulations, and terms of use referred to herein or provided by Socchh in relation to any services provided via the Socchh Platform (“Socchh Services”).
Socchh shall be entitled to modify these Terms of Service, rules, regulations, and terms of use referred to herein or provided by Socchh in relation to any Socchh Services, at any time, by posting the same on the Socchh Platform. Use of the Socchh Platform and Socchh Services constitutes the User's acceptance of such modified Terms of Service. Socchh may also notify Users of such changes by email, notification, or other communication. If the User does not accept the modified terms within the prescribed period, the User will be deemed to have accepted them.
Certain Socchh Services may be subject to additional rules. Where inconsistent, such additional conditions will prevail.
Socchh may, at its sole discretion:
• Restrict, suspend, or terminate any User’s access to all or part of the Socchh Platform or Socchh Services;
• Change, suspend, or discontinue all or part of the Socchh Platform or Services;
• Remove or move any material submitted by Users;
• Deactivate or delete User accounts and related information;
• Establish general practices and limits concerning use;
• Assign its rights and obligations under these Terms to any entity with due notice.
If a User breaches these Terms or misuses the platform, Socchh may, at its discretion, suspend or terminate the account, remove content, and take legal or technical action as necessary.
If Socchh charges a platform fee and removes a User due to platform negligence, such fee may be refunded. No refunds will be issued if removal results from the User’s breach or uncontrollable circumstances. By accepting these Terms, Users consent to receive communications, including announcements and advertisements, from Socchh or its affiliates.
2. Participation
Users may engage in skill development, learning modules, and other professional growth activities available through the Socchh Platform. To participate, Users must provide accurate information regarding their background, qualifications, and skills. Socchh may offer customized learning opportunities or recommendations based on this information. By enrolling or participating, Users confirm the information shared is accurate. Misleading or false information may result in account suspension. Upskilling records and activity logs may be stored and displayed on the User dashboard for tracking progress and engagement. Users agree to adhere to Socchh’s Code of Conduct.
3. Intellectual Property
All intellectual property on the Socchh Platform, including software, content, graphics, logos, etc., is owned by Socchh or its partners. Users may not copy, distribute, modify, or exploit such materials without written permission. Users are responsible for their own submitted content (“User’s Content”) and must have the rights to such content. Users agree not to infringe on third-party rights and to indemnify Socchh against any claims arising from such infringement. Users grant Socchh and its affiliates a global, royalty-free license to use, display, distribute, and store their content as required for platform operations. Trademarks and content belonging to third parties remain their property and must be addressed with the respective owners.
4. Third Party Sites, Services and Products
The Socchh Platform may link to third-party websites, apps, or service providers. Socchh is not responsible for the content or services of such third parties. Users’ dealings with third parties (e.g., service providers, external trainers, payment processors) are their responsibility. Socchh is not liable for any resulting issues or losses. Content on Socchh may include third-party contributions, which Socchh does not verify or endorse. 5. Privacy Policy All personal data collected (email, phone number, government ID, etc.) is governed by the Socchh Privacy Policy. Socchh does not share personal information without permission except in accordance with the Privacy Policy. Users must safeguard such data. Users must not share this data with third parties or misuse it. Violations may lead to account termination.
6. User Conduct
Users must follow these Terms and all Socchh rules. Violations may lead to account suspension, data deletion, or access restriction.
Users must:
• Provide accurate information and keep it updated;
• Operate only one Socchh account;
• Be able to receive communications from Socchh;
• Maintain password confidentiality and notify Socchh of breaches;
• Log out after sessions.
Users must not:
• Use automation tools or exploit vulnerabilities;
• Modify platform software;
• Overburden the platform infrastructure;
• Attack, disrupt, or impersonate others;
• Transmit harmful or illegal content;
• Engage in harassment or offensive behavior;
• Advertise or promote without permission;
• Collect or misuse personal data;
• Build databases for unauthorized use;
• Interfere with platform functionality.
Any violation may result in account action or legal remedies by Socchh.
7. Eligibility
The Socchh Platform is open only to persons above the age of 18 years and currently residing in India. Individuals must have a valid email address and/or mobile phone number to access the services. Socchh may, upon receiving relevant information or complaint, bar a person from accessing their Socchh account if found to be in violation of any part of these Terms of Service or the Code of Conduct. Only those Users who have successfully registered on the Socchh Platform shall be eligible to view or access the content and services offered through Socchh.
8. Dispute and Dispute Resolution
Any dispute arising out of, or in connection with, the services provided via the Socchh Platform, the validity or enforceability of these Terms of Service, or the rights and obligations of the User(s) or Socchh (“Dispute”), shall be resolved amicably. If such resolution is not reached within 30 (thirty) days of written communication, the Dispute shall be referred to arbitration. Arbitration shall be conducted by a sole arbitrator in accordance with the Rules of the Delhi International Arbitration Centre (DIAC). The seat and venue shall be New Delhi, and the language of arbitration shall be English. The arbitration award shall be final and binding. Nothing herein shall prevent any Party from seeking interim or injunctive relief from competent courts at New Delhi.
9. Release and Limitations of Liability
Users access the Socchh Platform voluntarily and at their own risk. Socchh shall not be held responsible for any loss or damage sustained during such use.
By accessing Socchh, Users agree to indemnify and hold harmless Socchh, its directors, employees, and partners against any liability or claims arising from their use, including any legal or financial consequences of actions taken by them. Socchh disclaims all liability for inaccuracies or omissions in content or services provided through third-party integrations or information. Users are responsible for any outcomes resulting from their misuse of the Platform or non-compliance with these Terms, including provision of false or unlawful information.
10. Disclaimers
To the fullest extent permitted by law:
• Socchh does not guarantee the uninterrupted, timely, or error-free operation of the Platform.
• Any content or material downloaded through the Platform is at the User's own risk.
• Socchh makes no warranties regarding the accuracy or quality of any materials or services obtained through the Platform. In the event of service suspension, modification, or termination, Socchh shall not be liable for any claims or demands from Users.
11. Grievance Redressal Mechanism
Users with grievances related to:
• Access to the Socchh Platform,
• Any content that may be obscene, defamatory, impersonating, or infringing, may contact us at: mindcentrictech@gmail.com
The complaint must include:
• Name, contact details, and description of the grievance.
• Relation to the subject (self or third-party representation).
• A statement confirming belief in the violation and accuracy of the complaint. For intellectual property infringement, include:
• Clear identification of the copyrighted work.
• Contact information.
• A good faith statement regarding unauthorized use.
• Authorized signature.
Grievances will be reviewed and investigated. Users may be contacted for further clarification.
